Fred Stumpf and Christy Denison successfully appealed a trial court decision holding that the Firm’s Nevada client was subject to jurisdiction in Texas in a suit involving employment and ownership issues in a Lexus dealership in Las Vegas.

Background

Mr. Stumpf has practiced in civil litigation in Houston since 1973. By 1976, Mr. Stumpf was the senior trial lawyer of a seven-attorney trial section at a mid-sized firm. In this role, he was responsible for several major items of litigation, as well as administratively responsible for all trial work. He resigned to establish this firm in 1978.

Mr. Stumpf has represented public and private companies and individuals in complex cases at all levels of the state and federal courts. He has served as a Special Master for the Harris County District Courts, overseeing a number of complex factual and legal issues. He has represented foreign and domestic clients in arbitrations conducted under the International Chamber of Commerce Court of Arbitration, the American Arbitration Association, and the National Association of Securities Dealers. In the bankruptcy area, Mr. Stumpf has litigated several adversary cases, has acted as counsel for trustees, and regularly represents secured creditors.

Mr. Stumpf has been certified by the Texas Board of Legal Specialization as a Civil Law Trial Specialist since 1986.

Mr. Stumpf served in the United States Army as a second lieutenant. He was was born in Lancaster, Pennsylvania, and has lived in Houston since 1970.



Selected Litigation/Transaction Highlights

  • Trial counsel for R. Allen Stanford in insurance coverage dispute against Certain Underwriters at Lloyds of London. Integral part of team that obtained preliminary injunction enjoining Underwriters from withdrawing the defense and compelling payment of defense costs in the criminal action pending in Houston and the SEC receivership action in Dallas.


  • Admissions elicited from the Government’s expert witness during Mr. Stumpf’s cross-examination resulted in a favorable jury verdict for the client, a natural gas trader accused of violating certain market manipulation and reporting provisions of the Commodity Exchange Act. The client was found liable on one count, but the trial court granted the client’s motion for judgment notwithstanding the verdict based upon Mr. Stumpf's evidentiary objections. The Fifth Circuit affirmed the decision in all respects. The trial victory and affirmation is believed be the first natural gas trading/reporting case in which a trader has prevailed over the government.
